TERMS & CONDITIONS FOR BUSINESS LISTING ON FOUNDERSCASH DIGITAL PLATFORMS

These Terms and Conditions ("Terms") govern the listing and publication of business information ("Listing") on the FoundersCash digital platforms, including but not limited to its website, mobile applications, and affiliated online channels ("Platform"). By registering and submitting your business details for listing, you ("Applicant", "Company", or "User") agree to comply with and be bound by these Terms.

1. Eligibility for Listing

Any business entity, including startups, MSMEs, or individuals looking for seed fund investment, whether in the ideation, conceptual, or operational stage, can apply for listing on the FoundersCash digital platform.

The Applicant must be a genuine business owner, founder, or authorized representative of the business.

FoundersCash reserves the right to review, verify, and approve or reject any listing application without assigning any reason at any time.

2. Purpose of Listing

The FoundersCash Platform provides a digital space for businesses to showcase their ideas, projects, and funding needs for attracting seed fund investors.

The Platform serves as a networking and visibility medium only — it does not act as an intermediary, broker, agent, or financial advisor between the business and potential investors.

FoundersCash does not guarantee any funding, partnership, or investment outcome.

3. Registration and Listing Fee

In special cases, as part of promotional campaigns, contests, or events, investment seekers may be permitted to register and list their business for FREE on the FoundersCash digital platforms.

However, during regular business operations, a nominal business listing fee may be charged for each business listing published on the platform. This fee covers the cost of verification, processing, platform publishing fee of the business profile on the FoundersCash Platform.

Payment shall be made through approved payment methods available on the website.

The fee is non-refundable under any circumstances, including rejection, withdrawal, or delisting.

4. Verification Process

Basic verification of submitted business details will be conducted by the FoundersCash team before publication.

Verification will be limited to document review and does not constitute authentication or endorsement of business performance, legality, or viability.

FoundersCash may request additional information or documentation at any time.

Failure to provide requested information may result in rejection or removal of the listing.

5. Publication of Business Details

After primary verification of the submitted data, the business details will be published on the FoundersCash digital platforms.

The publication will include the proposed or registered name of the firm or brand, along with its official logo (if provided).

The listing will also display the direct contact details of the business promoters or founders, including mobile number, WhatsApp number, email address, and postal address.

All such information will be considered open data, publicly accessible to any visitor or investor browsing the FoundersCash digital platforms.

FoundersCash shall not be liable for any unsolicited communications, misuse, or third-party contact made through publicly available information displayed as part of the business listing.

6. Responsibilities of the Business Owner

The Applicant is solely responsible for the accuracy and authenticity of all information submitted.

Any misleading, false, or incomplete information may lead to suspension or permanent removal from the Platform.

The Applicant must ensure compliance with applicable laws, including business registration, intellectual property, and investment regulations.

The Applicant must promptly notify FoundersCash of any updates or changes in business status or contact information.

7. Investor Disclaimer

FoundersCash does not provide any investment guarantee or assurance to any investor or business.

All investments made through direct contact between investors and businesses are at their own risk and discretion.

FoundersCash shall not be liable for any loss, fraud, or dispute arising out of such interactions.

8. Prohibited Content and Conduct

Businesses involved in illegal, unethical, or restricted activities shall not be listed.

The Applicant shall not post or promote misleading financial data, obscene, defamatory, or infringing content, or pyramid schemes.

Violation of this clause may lead to immediate delisting and legal action.

9. Duration and Removal of Listing

Each approved listing will remain active for one (1) year from the date of publication.

FoundersCash reserves the right to remove or suspend any listing at any time without prior notice if it violates these Terms.

Businesses may request voluntary removal in writing; however, listing fees will not be refunded.

10. Intellectual Property Rights

The Applicant retains ownership of all business information and materials submitted.

By listing, the Applicant grants FoundersCash a non-exclusive, royalty-free license to use, display, and promote the business content on its digital platforms and promotional materials.

11. Limitation of Liability

FoundersCash and its affiliates shall not be held liable for any loss, damage, or expense arising from use or misuse of business or investor information, investment losses, or technical errors.

FoundersCash's total liability, if any, shall not exceed the listing fee paid.

12. Data Privacy and Security

FoundersCash will maintain reasonable security measures to protect submitted data.

By listing, the Applicant agrees to the public visibility of business and contact details as part of the listing.

FoundersCash shall not be responsible for misuse of publicly available contact information by third parties.

13. Modification of Terms

FoundersCash reserves the right to amend, modify, or update these Terms at any time without prior notice.

Continued listing after such modification constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India.

Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the courts in Kochi, Kerala.

15. Important Disclaimer

Listing in the FoundersCash digital platform is not an authorization, recommendation, or merit-based entry for participation in FoundersCash investment pitching events. Both programs operate independently and follow entirely different eligibility and evaluation criteria.

Businesses listed on the FoundersCash digital platform do not automatically qualify for participation in any FoundersCash pitching, investor meeting, or funding session.

If any listed business entity meets the eligibility requirements prescribed for the FoundersCash Investment Pitching Events, they may apply separately through the official registration process as a new and independent application.

Listing approval or publication on the digital platform shall not be considered as validation, certification, or endorsement of the business, its model, financial performance, or fundability by FoundersCash or its management.

FoundersCash and its associates do not offer any guarantee or preferential treatment to businesses listed on the platform for subsequent funding rounds or investor engagement opportunities.

Participation in the FoundersCash Investment Pitching Events will require the applicant to fulfil all specific event criteria, including company registration status, operational history, documentation, and screening requirements.

FoundersCash reserves the exclusive right to accept, shortlist, or reject any application for its investment pitching events, regardless of listing status on its digital platform.

This disclaimer applies to all FoundersCash programs and aims to maintain fairness, transparency, and legal compliance.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

The invalid provision shall be replaced with a valid clause that most closely reflects the intent of the original.

17. Acceptance

By submitting a business for listing on the FoundersCash Platform, the Applicant acknowledges that they have read, understood, and agreed to these Terms and Conditions in full.
